The Massachusetts Fair Employment Law (MCEL) prohibits discrimination in employment on the basis of race, color, religion, sex, national origin, ancestry, age, genetic information, marital status, gender identity or expression, sexual orientation, disability, or military service. The MCEL also prohibits retaliation against employees who complain about discrimination or who participate in an investigation of a discrimination complaint.
The MCEL applies to all employers in Massachusetts, with the exception of religious organizations and the federal government. The MCEL also applies to employment agencies and labor unions.
If you believe that you have been discriminated against in violation of the MCEL, you can file a complaint with the Massachusetts Commission Against Discrimination (MCAD). The MCAD is an independent state agency that investigates discrimination complaints.
The MCAD can order a variety of remedies, including:
- Back pay
- Damages
- Injunctive relief
If you are not satisfied with the MCAD’s decision, you can file a lawsuit in federal or state court.
