The New Jersey Family Leave Insurance program provides eligible employees with up to 12 weeks of paid leave to care for a seriously ill family member, bond with a new child, or address certain military family needs.
To be eligible for Family Leave Insurance, an employee must have worked for a covered employer for at least 20 calendar weeks in the base year, earning a minimum of $220 per week during that time. Covered employers include those with at least 30 employees or those in certain industries.
During a period of Family Leave Insurance, eligible employees can receive up to 85% of their average weekly wage, up to a maximum of $943 per week as of 2023. The leave is job-protected, which means that the employee is entitled to return to the same or an equivalent position after the leave period ends.
Family Leave Insurance can be taken all at once, or intermittently in increments of one day or more. Employees are required to provide notice to their employer of their intention to take leave as soon as practicable, and must provide medical certification for certain types of leave.
